My second race ever was scheduled in a college town. I paid in advance, traveled to the community and spent a considerable amount on lodging, meals etc. The following morning I drove to the park where the race was scheduled and devoted about two hours to review the course, warmup etc. No one showed up thus, I assumed that the schedule was moved up and hour or more and I missed a late notification due to my early departure. I approached other visitors to the park and was informed that the race was rescheduled for the following week. Did I get mad? Hell no! I expect mistakes to be made thus, I just walked away. Since then I have returned several times and have always enjoyed myself. Athough I did not ask for a refund, the race director mailed a beautiful long-sleeved t-shirt. Now, my verdict. If I were on a jury to evaluate this situation, my initial response would be to direct the judge to through the case out. No question, from a pure legal standpoint, Jerry is definately right, however, I would be offended by his waste of valuable court resources with such a frivolous matter. But, on second thought, I strongly object to a defense that is based upon "pulling on my heart-strings." Thus, although its a tough call, I would find for Jerry. The clincher was my impression that Patti was riding just a little too high in the saddle.
